These Terms and Conditions ("Terms") govern your access to and use of the website www.dtplumber.com (the "Site") and any services provided by Dave the Plumber (the "Company," "we," "us," or "our"), a plumbing services provider operating in the State of Florida. By accessing the Site, requesting services, or engaging with the Company, you agree to be bound by these Terms. If you do not agree, do not use the Site or our services.
1. Use of the Site
- The Site provides information about our plumbing services, including scheduling, estimates, and general resources.
- You must be at least 18 years old to use the Site or request services.
- You agree not to use the Site for any unlawful purpose or in violation of these Terms.
- All content on the Site, including text, images, and logos, is owned by or licensed to the Company and protected by copyright and other intellectual property laws.
- Agency and Authority: If you are requesting services or scheduling an appointment on behalf of another person or entity (such as a homeowner, tenant, or business), you represent and warrant that you have the legal authority to act as their agent and to bind them to these Terms. The property owner and/or client of record will be held fully responsible for all terms, payments, and conditions agreed to by their designated agent.
2. Services
- The Company provides residential and commercial plumbing services, including but not limited to installation, repair, maintenance, drain cleaning, and emergency services (collectively, the "Services").
- Services are performed by licensed plumbers in compliance with Florida law and the Florida Building Code.
- License Disclaimer: The Company holds a valid plumbing contractor license issued by the Florida Department of Business and Professional Regulation (DBPR). License details can be verified on the DBPR website (myfloridalicense.com). We are not responsible for unlicensed work performed by third parties.
- Estimates provided via the Site or otherwise are non-binding and subject to on-site inspection. Actual costs may vary based on conditions discovered during service.
- Time estimates for Services are approximate and not guaranteed.
3. Scheduling and Cancellation
- Appointments must be scheduled in advance.
- Cancellations with less than 24 hours' notice may incur a fee.
- No-shows or last-minute cancellations may result in charges for reserved time and travel.
4. Payment Terms
- Payment is due upon completion of Services unless otherwise agreed in writing.
- Accepted payment methods include cash, check, credit card, and electronic transfer.
- Overdue amounts accrue interest at the maximum rate allowed by Florida law.
- We reserve the right to require deposits for large jobs or materials.
5. Insurance and Liability
- The Company maintains general liability insurance and workers' compensation insurance as required by Florida law.
- Limitation of Liability: To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the Services or use of the Site, including but not limited to property damage beyond the direct scope of work, loss of use, or business interruption.
- Our total liability shall not exceed the amount paid for the specific Services giving rise to the claim.
- We are not liable for pre-existing conditions, defects in materials supplied by the customer, or damage caused by normal wear and tear, misuse, or acts of God.
- Customer agrees to indemnify and hold the Company harmless from claims arising from customer's negligence or failure to disclose known hazards.
6. Warranties and Disclaimers
- Services are performed in a workmanlike manner consistent with industry standards.
- We provide a limited warranty on labor and parts as specified in writing at the time of service (typically 1 year on labor, pass-through on manufacturer warranties for parts).
- No Warranty on Pre-Existing Conditions: We are not responsible for failures due to pre-existing plumbing issues, corrosion, age of systems, or hidden defects not reasonably discoverable.
- Materials and fixtures may have separate manufacturer warranties.
- Site Disclaimer: The Site and its content are provided "AS IS" without warranties of any kind, express or implied, including accuracy, completeness, or fitness for a particular purpose. We do not warrant that the Site will be error-free or uninterrupted.
7. Customer Responsibilities
- Provide safe and reasonable access to the work area.
- Disclose any known hazards, such as asbestos, mold, or structural issues.
- Remove or protect personal property in the work area.
- Ensure utilities are available as needed.
8. Dispute Resolution and Governing Law
- These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict of laws principles.
- Any disputes shall be resolved exclusively in the courts located in Miami-Dade County, Florida.
- Mandatory mediation or arbitration may be required before litigation, as agreed in specific service contracts.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its officers, employees, and agents from any claims, losses, or damages arising from your use of the Site or Services, violation of these Terms, or negligence.
10. Changes to Terms
